§ 1. Scope of Application
The following terms and conditions apply to all services provided by the company Lischka Limos & Co. KG, in particular for passenger transport in occasional traffic, chartered bus services, rental car services, excursions with passenger cars, event organization, travel management, and temporary employment (labor leasing). These conditions also apply to all future business relationships, even if they are not expressly agreed upon again. By utilizing the service at the latest, these conditions are deemed to have been bindingly accepted. Deviations are only effective with written confirmation from Lischka Limos & Co. KG. Should the GTCs of our customers or other third parties conflict with the GTCs of Lischka Limos & Co. KG, our terms and conditions shall prevail, even if we were aware of the conflicting GTCs, did not object to them, and provided the service without reservation. For services carried out via partner agencies, the GTCs of the respective service provider shall apply.
§ 2. Conclusion of Contract
By registering, the customer offers Lischka Limos & Co. KG the binding conclusion of a transport contract. The contract is concluded on the basis of the following conditions of carriage upon written acceptance by Lischka Limos & Co. KG. If the content of the transport confirmation differs from the content of the registration, this constitutes a new offer from Lischka Limos & Co. KG. The contract is concluded on the basis of this new offer if the customer declares acceptance to Lischka Limos & Co. KG within the binding period of 10 days. A contract is only concluded if it is confirmed by Lischka Limos & Co. KG in writing or by telephone. The tariff list and service confirmation/transport order are part of the contractual conditions. Furthermore, the client undertakes to inform us of all factors relevant to the execution of the order, such as location, date, number of persons, desired vehicle, and number of pieces of luggage. Information and data must be available to Lischka Limos & Co. KG within a reasonable time and in a final, binding version. Lischka Limos & Co. KG is not obliged to check the data or documents transmitted to it for accuracy. If a vehicle category has been promised, Lischka Limos is entitled to replace the vehicle with an equivalent or higher-quality vehicle for operational reasons, if necessary.
§ 3. Prices
The currently valid price list or the concluded contract shall apply.
§ 4. Tariffs
The Transfer/City tariff applies only within the city area of Stuttgart.
§ 5. Additional Costs
Telephone charges, parking fees, road/ferry fees, hotel, meals for the driver, and entrance fees will be charged separately. If a limousine user soils the vehicle excessively, they must bear the costs of cleaning.
§ 6. Remuneration
Chauffeur rental, as well as the rental of the vehicle with a chauffeur, begins and ends at the company’s registered office. The period to be invoiced for one-day transport thus covers the duration of the desired chauffeur deployment from leaving the company headquarters until the return. For trips lasting several days, the costs for overnight stays in a middle-class hotel must be covered. If the working time starts before 12:00 noon on the first day, a minimum of 8 hours will be charged. On the second day, working time is calculated from the start of work, but at the latest from 8:00 a.m. The price list valid on the day of the trip applies. The return journey regulation corresponds to the one-day trip. For flat-rate agreements, the agreed price applies to the agreed rental period. For any time exceeding this, prices will be calculated according to the currently valid price list.
§ 7. Payment Terms
Prices are net prices, to which the statutory value-added tax (VAT) must be added. Before the start of the journey, a deposit of up to 50% of the total fare may be requested in advance. The remaining payments are due within the periods specified on the invoice. Payment by check is considered payment on account of performance. For the timeliness of payment, the receipt of the amount for the unconditional disposal of Lischka Limos & Co. KG is decisive. In the event of default in payment, the customer will be charged interest at a rate of 5% above the respective valid discount rate of the Deutsche Bundesbank. For payments by credit card in B2B business, we charge a processing fee of 4% of the final invoice amount. In B2C business, customers must provide their credit card as security and have the option to settle the invoice for the service in cash or by bank transfer after the end of the order. If the customer still wishes to pay the invoice by credit card or PayPal, a processing fee of 4% also applies.
§ 8. Cancellation / Rebooking
Rebookings and cancellations only become effective if they are made in writing or confirmed in writing in the case of a telephone message. Unless otherwise agreed, Lischka Limos & Co. KG does not charge any fees for rebookings and cancellations up to 24 hours (local time) before the contractually determined start of the journey (vehicle start). After that, 100% of the expected or agreed costs are due as compensation for expenses. Special expenses not included in the tariff list will be charged by Lischka Limos & Co. KG regardless of the timeliness of the cancellations. For the timeliness of written cancellations, the receipt at Lischka Limos & Co. KG is decisive. If rebookings can no longer be implemented within 24 hours before the original start of the vehicle, and the customer wishes to withdraw from the order or individual components of the order, this is treated as a cancellation of the order or individual order components. Separate cancellation conditions apply to bookings for weddings, larger events, and coaches.
§ 9. Delays
Additional costs caused by delays are at the expense of the customer, unless the delays are due to the fault of Lischka Limos & Co. KG or a chauffeur. The basis for the safe execution of the order is reservation and punctual departure. In the case of imprecise orders or delayed departures, Lischka Limos & Co. KG assumes no responsibility for late arrival at the destination. Lischka Limos & Co. KG is exempt from liability insofar as exceeding the transport duration is based on circumstances which it could not have avoided even with the greatest care and the consequences of which it could not have averted. Passengers are obliged to notify us of rebookings that take place after the order has been placed, either in writing or by telephone. These will then be confirmed by us in writing, provided the rebooking is possible. In the event of non-notification, our obligation to transport expires, but not the customer's obligation to pay for the booked service. Transfer delays: In the event of flight or train delays of more than 1.5 hours, there is no entitlement to the booked transport service, and it will be treated as a cancellation. Naturally, Lischka Limos & Co. KG will always try to provide a corresponding replacement. The customer bears the additional costs.
§ 10. Transport
There is no general obligation to transport. Passengers must follow the instructions of the chauffeur. If passengers act contrary to the instructions of Lischka Limos & Co. KG or the chauffeur, or if they represent a danger according to the StVO (Road Traffic Regulations) or the safety of road traffic by impairing the driver, Lischka Limos & Co. KG or the chauffeur is entitled to exclude them from transport. In this case, Lischka Limos & Co. KG will charge the full fare including the mileage price and all ancillary and special services. The StVO, in particular the obligation to wear seat belts, applies to all passengers during the entire travel time. Smoking is strictly prohibited in the vehicles. The consumption of food is only permitted in consultation with the chauffeur; drinks may be taken into the vehicles at any time. In this regard, § 4 must be observed. The transport of children under 12 years of age must be specified in the booking request. Fixed prices apply to one pick-up address and a one-way trip on the direct route from A to B. The price includes one suitcase and one piece of hand luggage per adult; excess luggage must be registered at the time of booking. In the case of unregistered excess luggage, transport of the excess luggage is not mandatory. The carriage of pets is only permitted by prior arrangement and may lead to an increase in the fare.
§ 11. Withdrawal/Cancellation by Provider
Lischka Limos & Co. KG is entitled to withdraw from the contract at any time if the execution of the journey becomes impossible, the customer violates an obligation incumbent upon them under these contractual provisions, or in the event of grossly improper behavior by the passengers. The transport contract is void if the customer does not meet their payment obligations, suspends their payments, or if an application is made for the opening of composition or bankruptcy proceedings regarding their assets. In the event of difficult weather conditions, Lischka Limos & Co. KG decides on the execution of the trip. Lischka Limos & Co. KG is not responsible for performance delays due to force majeure and due to events that make performance significantly more difficult or impossible (e.g., technical breakdowns, weather-related circumstances, power failure, official requirements, road closures, traffic obstructions), even if these occur at subcontractors or suppliers, even in the case of bindingly agreed deadlines. They entitle the provider to postpone the service for the duration of the impairment or to withdraw from the contract in whole or in part.
§ 12. Liability of the Client
The client is liable for all damage caused culpably by them or the passengers to and in the vehicles. In the event that the passenger does not assume the rental price, the client is liable for payment.
§ 13. Liability of Lischka Limos & Co. KG
Lischka Limos & Co. KG assumes no liability for damages, unless the damages are due to intent or gross negligence on the part of Lischka Limos & Co. KG or the chauffeur. In the event of a claim, damages are covered by the motor vehicle rental insurance (€100 million flat rate for personal injury, property damage, or financial loss, but no more than €8 million per injured person) or business liability insurance (personal injury €2 million / property damage €1 million / financial loss €100,000). In the case of property damage, the liability of Lischka Limos & Co. KG is limited to €500.00 for each person at risk. Lischka Limos & Co. KG does not guarantee arrival times and is not liable for delays in the transport of the customer, unless the delayed arrival was caused by grossly negligent action or intentional behavior of Lischka Limos & Co. KG or the chauffeur. The travel times of the vehicles are determined according to average traffic conditions and are without guarantee. Deviations from travel and arrival times, in particular due to traffic obstructions, operational disruptions or interruptions, unforeseeable extraordinary circumstances such as strikes, war, riots, official orders, etc., as well as lack of space and incorrect information, do not justify claims for compensation. In this respect, no guarantee is assumed for the meeting of connections of any kind. To this extent, Lischka Limos & Co. KG is not liable for lost profits or other damages of the customer. Unless otherwise stated below, claims for damages by the customer from the execution of the transport are excluded. Should a transport not be carried out or not be carried out on time or completed, and the cause is the failure of a vehicle for reasons for which Lischka Limos & Co. KG is responsible, the customer's claim for damages is limited to the execution of a replacement transport and the replacement of the costs for the accommodation of the customer until a vehicle is provided. Further compensation for damage is excluded. In particular, Lischka Limos & Co. KG assumes no liability for consequential, personal, and financial damage; unless these damages were caused intentionally or through gross negligence. Furthermore, the customer is obliged to contribute everything reasonable to minimize the damage. This disclaimer of liability does not apply if the cause of the damage is based on intent or gross negligence. It also does not apply if the customer claims damages for non-performance due to the lack of a guaranteed quality. Any further liability for damages is excluded—regardless of the legal nature of the asserted claim. This regulation does not apply to claims from initial incapacity or representative impossibility. Since liability is excluded or limited, this also applies to the personal liability of employees, workers, staff, representatives, vicarious agents, and freelancers of Lischka Limos & Co. KG.
Comprehensive Insurance and Limitation of Liability in Chauffeur Service (Customer Vehicle) Unless otherwise agreed, the following regulations apply:
- The customer is obliged to ensure sufficient insurance for the car provided by them and to insure it with full comprehensive insurance (Vollkasko). If the vehicle is not fully insured, the customer is also liable for the damage incurred in the event of grossly negligent behavior by the contractor or the driver employed by them. A deductible agreed between the insurance company and the customer as well as the costs due to any increasing insurance premiums shall be borne by the customer, unless the contractor acted intentionally or with gross negligence. The vehicle must not have any defects that could impair the roadworthiness of the vehicle within the meaning of the StVZO. The driver's assessment that the vehicle meets the requirements of the StVZO does not release the customer from this duty. The customer is responsible for the necessary accompanying documents (registration documents, insurance confirmation) and is liable for all costs incurred due to technical defects in the vehicle and/or insufficient accompanying documents.
- If a vehicle owned by a third party is used for the driving service, Lischka Limos & Co. KG is entitled to take out comprehensive insurance for this vehicle on behalf of the customer and to invoice the customer for the costs incurred as a result, enclosing corresponding evidence. At the customer's request, these costs incurred by the contractor must be proven.
- Insofar as insurance coverage exists within the framework of statutory liability insurance or business liability insurance, Lischka Limos & Co. KG is liable to the customer in the event of damage within the framework of the statutory provisions applicable to liability. Insofar as the liability insurance is liable to pay in the event of damage, liability for property damage and loss is limited to a maximum of €500.00 per booking, provided the damage was caused neither intentionally nor negligently. This also applies to persons working for Lischka Limos & Co. KG, such as vicarious agents and legal representatives.
§ 14. Invalidity of Individual Provisions
The invalidity of individual provisions of the transport contract or the General Terms and Conditions shall not result in the invalidity of the entire contract.
§ 15. Place of Jurisdiction
The place of jurisdiction for all disputes is Stuttgart.
